This chapter considers government-imposed formalities on the existence or exercise of copyright. Examples include filing a registration claim with a government agency, providing copies of the work to government agencies or libraries, and affixing a notice of copyright on each publicly distributed copy of the work. These requirements have been greatly liberalized over time and largely abolished. The chapter argues for the re-imposition of some formalities to ensure that copyright owners may protect their investment for a reasonable period of time, but that the public is not inadvertently subject to infringement and to enormous financial damages.
