This chapter examines how public health insurance systems deal with medical tourism, with a focus on the European Union, which, for the last three decades, has struggled in setting the rules in this regard. The first part gives a brief overview of the different health care systems in the European Union and the primary legal documents enabling cross-border access to care. The second part examines the tangled European Court of Justice (now renamed the Court of Justice of the European Union) case law interpreting these documents and setting ground rules for reimbursement for cross-border health care. It then examines the newly issued European Directive and the numerous legal and ethical issues it leaves open. A Final section briefly considers possible implementation of medical tourism programs in non-EU public health insurance programs, such as U.S. Medicaid and Medicare, taking some of the lessons learned in the EU context as inspiration.
