This chapter examines the role of transnational tobacco companies in the development and spread of bilateral investment treaties (BITs) in order to allow for better future BITs negotiations and governance in tobacco control. It begins with an overview of BITs. It hen discusses how the tobacco industry used BITs to facilitate the spread of tobacco worldwide, and concludes with implications of BITs for governance in tobacco control.
