The chapter defines the central conceptual parameters for the book, focusing on the notions of ‘Internet governance’, ‘contract’, and ‘statute’. More particularly, it: (i) defines the field of Internet governance in a way that is amenable to legal analysis; (ii) identifies distinguishing characteristics of contract and statute; and (iii) situates the role of contract and statute—as instruments of ‘hard law’—in the overall context of Internet governance. The chapter devotes considerable space to a discussion of the various meanings of ‘internet governance’, emphasizing that the term’s definition affects assessment of the role played by contract relative to, for example, statute.
