This chapter reviews some of the issues central to establishing the structure of the UNCC and its initial operating procedures that were the focus of discussion in 1991. This chapter also addresses the method of funding the UNCC: the operation of the oil mechanism and the Compensation Fund used to fund the UNCC’s operations, as well as the payment of compensation awards, and the related issue of the percentage of Iraq’s oil exports captured under that mechanism. No one predicted that Iraq would not export any oil for five years, creating repeated funding crises. And no one predicted that, once oil exports began, and until 2003, humanitarian concerns created by the allocation of resources by the Iraqi government would be played off against claims interests to put pressure on the level of funding provided for compensation. This chapter also reviews the attempted supervision of the claims process by the UN Office of Internal Oversight Services (OIOS).
