This chapter highlights selected legal issues, which were reviewed by panels and the Appelleate Body in reports adopted in 2012. In particular, three disputes reviewed under the Agreement on Technical Barriers to Trade provided the Appellate Body with an opportunity to clarify the notions of ‘technical regulations’ and ‘international standardizing bodies’, as well as the scope of the non-discrimination obligations under that Agreement. Other disputes involved trade remedy measures, taxes on distilled spirits, restrictions on exports of raw materials, and restrictions on electronic payment services. The disputes involved not only several WTO agreements, but also China’s obligations under its Accession Protocol.

Keywords:   technical regulations, labeling requirements, less favourable treatment, exhaustible natural resources, likeness of products, anti-dumping duties, subsidies, safeguards, export restrictions
