This chapter argues that this kind of influence can be seen in the legislature, but, in England, much less in the courts than some of the proponents of the influence view would have us believe. On the one hand, English insurers have a history of innovation and enterprise; they are always looking for new ways of making money by launching new kinds of cover. However, they are not social engineers or industrial enterprise boards seeking to advance the prosperity of the nation. They watch and assess the line taken by the courts rather than lead or cajole the courts in any particular direction.
