This chapter examines the implementation of economic, social, and cultural rights (ESC rights) under the African human rights system through a critical evaluation of the activities of the African Commission on Human and Peoples' Rights (the Commission). It highlights possible ways of enhancing the realization of the economic, social, and cultural rights guaranteed under the African Charter on Human and Peoples' Rights (ACHPR). It argues that the jurisprudence of the African Commission on ESC rights ‘boldly establishes the justiciability of ESC rights and thereby challenges the outdated notion of the non-justiciability of ESC rights’. However, there can be further improvement to ensure the full and practical realization of the ESC rights under the African regional human rights system.
