This chapter examines how the World Trade Organization (WTO) dispute settlement tackles the issue of joint membership of the European Community (EC) and its Member States. It describes actual practices in WTO dispute settlement and considers some of the underlying theoretical questions in the current debates concerning the International Law Commission (ILC). The WTO appears to accept the practice that the EC is responsible for violations, even by its Member States.
