A Reader on Regulation

G. Teubner

Oxford University Press

This chapter discusses the concepts, aspects, limits, and solutions to juridification. It considers the problem of the definition of juridification. In the current debate, the term has come to designate so many diverse phenomena that it must be carefully delineated before any sensible pronouncements can be made about it. It argues that the phenomenon of juridification is a partial aspect of societal evolution and cannot be effectively reversed by delegalization strategies. The only approaches which can be taken seriously are those which seek to deal with the dysfunctional consequences resulting from juridification.

Keywords:   juridification, societal evolution, regulation, delegalization
