This chapter discusses the warranty of title and of property quality in the contract of sale. The first part explores the liability for eviction. It describes the warranty of peaceable possession, liability under the actio auctoritatis, stipulatio duplae, and the actio empti, the position under Justinian, the determaniation of quod interest, and Roman-Dutch and modern German law. The second part examines the liability for latent defects. It examines the early remedies, liability for dolus and dicta venditione, liability arising from specific promissa, the aedilitian remedies, extended liability under the actio empti, and mortus redhibetur.
