Abstract

This book presents a principled and coherent scheme for national identity adjudication by the Court of Justice of the European Union. The Court of Justice has lately been faced with an increasing number of claims based on national identity. With growing frequency, Member States invoke their national identity in an attempt to justify a derogation from a requirement imposed on them by a Treaty article or EU legislation, or to legitimize a particular national reading of such an EU norm.
