This chapter examines the principle of orality and the vulnerable witness in relation to the criminal justice system in Great Britain. It reviews the results of psychological research that has in recent years provided substantial grounds for questioning the wholesale rejection of evidence tendered at the pre-trial stage of proceedings in favour of that elicited in court. It also discusses studies of eyewitness memory, which reveal that accounts given at trial many months after a witnessed incident are invariably affected by so-called post-event information.
