This chapter examines the International Law Commission's (ILC) study on legal principles relating to the responsibility of the state and on defences in the jurisprudence of international tribunals. It highlights the importance of the decisions in the cases Air Services Agreement, Rainbow Warrior, and Gabcikovo-Nagymaros on the ongoing debate in the ILC. It explains that these judgements consider the relationship between the law of treaties and the law of responsibility.
