Law in Context

William Twining

Oxford University Press

This chapter relates the experiences of the author at the University of Khartoum in Sudan. The anecdotes in here can all be interpreted as cross-cultural parables from which one could draw a variety of morals. Law needs to be studied in its specific cultural, political, and economic context; when studying foreign law and legal sources in a country like Sudan every rule, institution, and idea needs to be examined and tested for its suitability and applicability for import to a different cultural environment; one form of post-colonial dependency is dependency on foreign literature; law in books often diverges from law in action, but the gap between law in books written in one country and law in action in another country can be very much greater, particularly when the countries do not share a common language and culture.

Keywords:   University of Khartoum, Sudan, cultural environment, morals, foreign law, post-colonial dependency
