This chapter defines certain matters of terminology before discussing the substance of diem diffindere. In modern works, the term diem diffindere is often discussed in the company of diffusio and comperendiantio, and the three terms are not clearly distinguished. Comperendiantio is sometimes used to describe to an aspect of diem diffindere, and diem diffindere is often interchanged with diffusio. While diffusio and diem diffindere refer to the same practice, the latter is the more authentic term and should be preferred. The term diem diffindere refers to an adjournment of a civil trial. This term is discussed in detail using the Twelve Tables as its principal source.
