Accountability for Crimes of War and Crimes Against Humanity

(p.123) Chapter 4 International Criminal Law
Humanitarian Law in Action within Africa

Jennifer Moore

Oxford University Press

This chapter examines international criminal law and its role in ensuring accountability for war crimes and crimes against humanity, with particular emphasis on the various international criminal tribunals for Rwanda, Sierra Leone, and the former Yugoslavia, along with the International Criminal Court. It suggests that restorative and reconciliative justice mechanisms are also components of criminal justice, at times undercutting but often complementing its predominantly retributive approach. Restorative justice mechanisms in Uganda, Sierra Leone, and Burundi are briefly referenced.
