Notes:

(1) There was a successful appeal to the Court of Appeal outside the period from which my sample was taken, for which the citation is [2010] EWCA Civ 921. This was against the finding in the Employment Tribunal, upheld in the Employment Appeal Tribunal, of race discrimination (but not against the upheld finding of constructive unfair dismissal).

(2) There was a successful appeal to the CSIH outside the period from which my sample was taken, reported at [2013] CSIH, [2015] ICR 27. As a result the ET’s finding that there had been a constructive unfair dismissal was reinstated.

(3) There was a successful appeal to the CSIH outside the period from which my sample was taken, reported at [2011] CSIH 33, 2011 S.C. 736, such that Mr Marinello was allowed to proceed with his claim under the PHA 1997.
