Law, Justice, and Gender

Law, Justice, and Gender

(p.xxi) Law, Justice, and Gender
Family Law Volume 2

Flavia Agnes

Oxford University Press

The law, justice, and gender have been the three major concerns in weaving women’s rights into legal theory. The term ‘law’ conceives law as a social mediator of relationships between people within the broader spectrum of legal realism. The notion of ‘justice’ is explored in the context of legal interpretations of women’s claims. ‘Justice’ is the key concern of law or in other words, law is centrally implicated in the project of justice. While theorizing about women’s rights, ‘gender’, on the other hand, becomes a useful term to signify a deeply entrenched institutionalization of sexual difference which permeates the society. The contours of feminist legal theory are explored. Moreover, an overview of the chapters included in this book is provided.

Keywords:   law, justice, gender, women’s rights, feminist legal theory, sexual difference
