This chapter discusses certain basic issues with respect to the contract forming a common law marriage. These include the nature of the marriage contract, the content of the marital intent, the distinction between contracts de praesenti and de futuro, the express contract, and specific issues arising with respect to disparities between the actual intent and the expression of intent (sham marriages).
