Monitor, the Independent Regulator of NHS Foundation Trusts
This chapter applies the arguments developed in Chapter 1 to Monitor, the regulator of NHS foundation trusts. Its origins are described in the context of the development of foundation trusts, as are its functions of economic regulation and regulation of trust governance. Its structure and duties are described, as are its relations with government and with the quality regulators discussed in the previous chapter. Monitor is analyzed primarily as an economic regulator with a major stress on a risk-based approach and on incentivization but one with important responsibilities relating to governance and service delivery which raise issues of social solidarity. There is also examination of Monitor's procedures and arrangements for patient representation.
